BSG birds Finland

BSG – Finnish Birds Model License (Version 1.0)

1. Definitions

1.1. “Model” refers to the BSG – Finnish Birds Model and any related new code developed at the University of Jyväskylä (licensed for the first time in 2025). It contains (or is partially derived from) the original BirdNET-Analyzer model, which is released under the MIT License.

1.2. “Non-commercial Purposes” means use that does not involve charging fees or any other form of compensation and does not directly or indirectly support commercial activity or commercial services.

1.3. “Scientific or Academic Purposes” refers to use of the model by universities, research institutes, or similar non-commercial organizations for research and teaching purposes.

2. Granted Rights and Restrictions

2.1. License Grant: The Licensor (University of Jyväskylä) grants to any person or entity that obtains a copy of the Model the right to use, copy, and modify the Model exclusively for Non-commercial, Scientific, or Academic Purposes.

2.2. Prohibition on App Stores: Model must not (in whole or in part) be included, distributed, or used in applications published or distributed via the Apple App Store, Google Play Store, or any similar platforms without a separate, written permission from the Licensor.

2.3. Prohibition on Commercial Use: Model may not be used or exploited, directly or indirectly, for commercial purposes or as part of a paid service or product. Prohibition on commercial use also includes utilizing the Model in services or products initially distributed for free but enabling paid subscriptions or purchases via the product or service.

2.4. Derivative Works: Any modifications, derivatives, or other software incorporating the Model must retain these same restrictions. Such derivatives must clearly indicate that they include (or are based on) the BSG – Finnish Birds Model. Both the original MIT License for BirdNET-Analyzer model and this BSG – Finnish Birds Model License for the BSG – Finnish Birds Model must be included and preserved in any further distribution.

3. MIT License and BirdNET-Analyzer model

3.1. The original BirdNET-Analyzer model´s code and model are published under the MIT License. Pursuant to the terms of the MIT License, the MIT license text and original copyright notices must be included in full whenever the Model or any derivatives are distributed.

3.2. BirdNET-Analyzer model code included in the BSG – Finnish Birds Model remains under BirdNET-Analyzer model’s MIT License. All new code or data created by the University of Jyväskylä is covered by this BSG – Finnish Birds Model License.

4. Limitation of Liability

4.1. Model and its related code are provided “as is,” without any warranty of any kind. The Licensor shall not be liable for any damages, losses, or harm resulting from the use of the Model or code.

4.2. The Licensor does not guarantee that the Model will operate as intended or predicted under any circumstances.

5. Effective Date and Termination

5.1. This License takes effect once the Licensee receives or downloads the Model/code.

5.2. If the Licensee breaches any term of this License, the License shall automatically terminate without further notice, and the Licensee must cease all use and distribution of the Model or code.

6. Governing Law and Dispute Resolution

6.1. This License and its interpretation shall be governed by the laws of Finland.

6.2. Any disputes shall be resolved primarily through negotiations. If negotiations fail, disputes shall be settled in the District Court of Central Finland under Finnish law.

7. General Terms

7.1. If any provision of this License is found to be invalid or unenforceable, it shall not affect the validity or enforceability of any other provision.

7.2. The Licensor may publish new versions of this License, which may include clarifications or modifications. However, previous versions remain valid for copies of the Model already distributed under those terms.
